FreeHomayoun: Πρώτη υπόθεση στον Άρειο Πάγο - πιθανότητα για απόφαση-ορόσημο σε δίκες για φερόμενη «παράνομη είσοδο»

Στις 19 Σεπτεμβρίου 2025 θα εξεταστεί στον Άρειο Πάγο, το ανώτατο δικαστήριο της Ελλάδας, η υπόθεση του Homayoun Sabetara. Η αθώωσή του θα μπορούσε να ανοίξει τον δρόμο για περισσότερους από 2.000 ανθρώπους που κατηγορούνται στη χώρα για το ότι δήθεν «βοήθησαν παράνομη είσοδο».

Ο Homayoun Sabetara έφυγε από το Ιράν το 2021 για να σμίξει με τα παιδιά του στο Βερολίνο. Στα σύνορα Τουρκίας-Ελλάδας αναγκάστηκε να οδηγήσει ένα αυτοκίνητο με άλλους επτά ανθρώπους. Λίγο μετά συνελήφθη στη Θεσσαλονίκη με την κατηγορία της «διακίνησης». Παρά την έλλειψη αποδείξεων και την απουσία βασικού μάρτυρα, καταδικάστηκε αρχικά σε 18 χρόνια φυλακή. Αργότερα, το Εφετείο μείωσε την ποινή σε 7 χρόνια· από τον Δεκέμβριο του 2023 είναι με αναστολή.

«Ελπίζω ότι με το να μιλάω για αυτά τα θέματα μπορώ να βοηθήσω να αλλάξουν τα πράγματα. Ίσως καταφέρω να βοηθήσω όσους είναι ακόμα στη φυλακή. Ξέρω ότι οι περισσότεροι είναι αθώοι. Έκατσα μαζί τους, μίλησα μαζί τους, έζησα μαζί τους», είπε ο Sabetara σε συνέντευξή του τον Ιανουάριο 2025.

Παρόλα αυτά, μόνο μια οριστική αθώωση θα του δώσει το δικαίωμα να μείνει με ασφάλεια στην Ευρώπη. «Η δίκη αυτή δεν αφορά μόνο τον Homayoun Sabetara, αλλά είναι και σημαντικό παράδειγμα για χιλιάδες άλλους σε παρόμοιες υποθέσεις», τονίζει η καμπάνια FreeHomayoun. Κατά μέσο όρο, τέτοιες άδικες δίκες οδηγούν σε ποινές περίπου 47 ετών («Ένα νομικό κενό», borderline Europe https://www.borderline-europe.de/sites/defaul… ).

Η υπόθεση του Homayoun Sabetara είναι η πρώτη που φτάνει μέχρι τον Άρειο Πάγο. Αυτό έγινε δυνατό χάρη στους δικηγόρους του αλλά και με μεγάλο οικονομικό βάρος: η προσφυγή στο ανώτατο δικαστήριο κοστίζει 6.500 €. Ήδη έχει καλυφθεί περίπου το μισό ποσό μέσω συνεισφορών , ενώ το υπόλοιπο πρέπει να συγκεντρωθεί μέχρι την ημέρα της δίκης.

FreeHomayoun: First case before the Areios Pagos - chance for a precedent-setting ruling in proceedings against alleged unauthorized entry

On 19 September 2025, the case of Homayoun Sabetara will be heard before the Areios Pagos, Greece's highest court. His acquittal could set a precedent for more than 2,000 other people on the move who are being criminalised in Greece for allegedly 'aiding illegal entry'.

Homayoun Sabetara left Iran in 2021 to join his children in Berlin. At the Turkish-Greek border, he was forced to drive a car with seven other people. Shortly afterwards, he was arrested in Thessaloniki on charges of 'human smuggling'. Despite a lack of evidence and a key witness who never appeared, he was initially sentenced to 18 years in prison. The Court of Appeal later reduced the sentence to seven years; he has been on parole since December 2023.

'I hope that by raising these issues, I can contribute to change. Perhaps I can help those who are currently imprisoned. I just know that most of them are innocent. I sat with them, talked to them and lived with them,' said Homayoun Sabetara in an interview in early January 2025.

However, only an acquittal would grant him a secure right to remain in Europe. 'This trial is therefore not only crucial for Homayoun Sabetara, but also sets an example for thousands of other people in similar proceedings,' adds the FreeHomayoun campaign. On average, these unfair proceedings result in prison sentences of around 47 years ('A legal vacuum', borderline Europe https://www.borderline-europe.de/sites/defaul…).

Homayoun Sabetara's case is the first of its kind before the Areios Pagos. The fact that it is being heard there is thanks to the commitment of his lawyers - and high costs: appearing before the Supreme Court costs €6,500. Around half of this has already been covered by fundraising campaigns, and the remaining amount must be raised by the day of the trial.
